1. Acceptance of Terms
Welcome to gentlemensyachts.com (the "Site"), operated by Gentlemen's Yachts, a division of Cape Fear Brokerage, LLC ("Gentlemen's Yachts," "we," "us," or "our"). By using the Site, submitting an inquiry, or engaging with our services, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Site.
Our collection and use of your personal information is described in our Privacy Policy, which is part of these Terms.
2. What Gentlemen's Yachts Does
Gentlemen's Yachts features classic American yachts and acts as a buyer's agent, helping buyers find and acquire them. Many yachts shown on the Site are listed by other brokers or owners. We present a short description and a link to the original listing, and we may help you inquire about the yacht.
Submitting a form on the Site does not, by itself, create a brokerage, agency or representation relationship between you and us. Any such relationship exists only under a separate written agreement signed by both parties.
Buyer's agent services and fees. Browsing the Site and submitting an inquiry are free. If you ask us to search for a yacht on your behalf, we do so under a separate written agreement that sets out the scope of our services and our fees. Our buyer's-agent search retainer is $500 per month, and retainer amounts you have paid are credited toward our compensation at closing if you purchase a yacht through us. Our compensation on a purchase is ordinarily paid through a commission split with the listing broker, as described in your agreement with us.
Independent professionals. We may recommend independent professionals, such as marine surveyors, delivery captains and transaction specialists. They are not employees or agents of Gentlemen's Yachts, and you engage and pay them separately. If we receive a referral fee or other compensation from a professional we recommend, we will disclose it to you in writing.
3. Listings and No Warranty
Yachts and vessels shown on this Site are presented "as is" and "where is," without warranty of any kind, express or implied. Listing information, including specifications, condition, equipment, photographs, pricing and descriptions, comes from the listing broker, the owner or other sources and is believed to be accurate but is not verified or guaranteed by us. We do not warrant its accuracy, completeness or currentness, and a yacht may already be sold or no longer available.
We make no representations about the seaworthiness, mechanical condition, title status or fitness for a particular purpose of any vessel. Buyers are strongly encouraged to inspect any vessel, obtain a survey from a qualified marine surveyor, and conduct a sea trial before purchasing.
4. Third-Party Links and Services
The Site links to listings and websites operated by others, including brokers, marketplaces, builders and social platforms. We do not control and are not responsible for those sites, their content, or their practices. Your use of any third-party site is subject to that site's own terms and policies.
5. Use of the Site
You agree to use the Site only for lawful purposes. You agree not to:
- Violate any applicable federal, state or local law
- Attempt to gain unauthorized access to the Site, our servers or connected systems
- Interfere with or disrupt the Site's functionality
- Use bots, scrapers or crawlers to access or collect data from the Site without our written permission
- Submit false, misleading or fraudulent information through any form
- Transmit any harmful code, virus or malicious software
We may restrict or end your access to the Site at our discretion, without notice, if we believe you have violated these Terms or are harming our business or others.
6. Forms and Communications Consent
By submitting a form on the Site, you represent that the information you provide is accurate and you consent to be contacted by Gentlemen's Yachts by phone and email about your inquiry, as described in our Privacy Policy.
Text messages. If you check the text-message consent box on our form, you agree to receive text messages from Gentlemen's Yachts at the mobile number you provide, including messages sent using automated technology. Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out, or HELP for help. Consent to receive text messages is not a condition of any purchase or of using our services. See Section 4 of the Privacy Policy for more.
Submitting a form does not obligate us to find or sell you any specific vessel.
7. Intellectual Property
The Site's text, design, logos and layout are the property of Cape Fear Brokerage, LLC or its licensors and are protected by copyright, trademark and other laws. You may view and print content from the Site for your personal, non-commercial use in evaluating a potential yacht purchase. You may not reproduce, distribute, modify, publicly display or create derivative works from Site content for commercial purposes without our prior written consent.
Photographs, descriptions and other materials about yachts may belong to the listing broker, owner, photographer or builder, and remain subject to their rights. If you believe material on the Site infringes your rights, contact us at
8. Disclaimer of Warranties (Use of the Site)
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GENTLEMEN'S YACHTS, CAPE FEAR BROKERAGE, LLC AND THEIR OWNERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, ANY VESSEL SHOWN ON THE SITE, OR ANY TRANSACTION RELATED TO THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). THIS LIMITATION DOES NOT APPLY TO SEPARATELY SIGNED BROKERAGE, BUYER'S AGENT OR PURCHASE AGREEMENTS, WHICH ARE GOVERNED BY THEIR OWN TERMS.
10. Indemnification
You agree to indemnify, defend and hold harmless Gentlemen's Yachts, Cape Fear Brokerage, LLC and their owners, employees and agents from claims, damages, losses, liabilities and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any third party's rights.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the Site must be brought exclusively in the state or federal courts located in New Hanover County, North Carolina, and you consent to the personal jurisdiction of those courts.
12. Changes to These Terms
We may revise these Terms at any time by updating this page. Changes take effect when posted. Your continued use of the Site after changes are posted means you accept the revised Terms.
13. Severability
If any provision of these Terms is found to be unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining Terms will stay in effect.
